These Terms & Conditions govern your use of the AMS Fabrication website and the supply of goods and services by AMS Fabrication Pty Ltd ("AMS", "we", "us"). By using this website, you agree to these terms. If you do not agree, please do not use the site.
The amsfabrication.com.au website provides general information about our metal fabrication business, our services, our workshop capability and our past projects. It is a business information site. Content on the site is provided in good faith for general guidance and does not constitute a quote, tender, tender response, contractual offer or professional advice for any specific project.
We aim to keep the information on this website accurate and up to date. However, specifications, equipment lists, service descriptions, photographs and pricing references are indicative only and may change without notice. We do not warrant that the site will be uninterrupted, error-free, or that the content is completely free from inaccuracies. Material shown in project photographs is shown for illustrative purposes and does not represent a commitment to supply identical work for any future project.
A quote issued by AMS in writing (by email or formal written quote) is valid for the period stated on the quote. If no period is stated, we recommend confirming at the time of order. No contract for the supply of fabricated goods arises until AMS accepts your order in writing. A quote is based on the drawing, material, quantity, finish and tolerances you provide; any change to the drawing or specification may result in a revised price and lead time.
We may require a deposit before work begins, particularly for custom or one-off jobs. The balance is due on completion unless otherwise agreed. Payment terms will be stated on the invoice. Late payments may incur reasonable recovery costs.
You warrant that any drawing, file (DXF, DWG, STEP, PDF sketch) or design information you send to us is either owned by you or that you have permission to provide it to us for quoting and fabrication. You retain ownership of your designs. We retain ownership of our workshop processes, jigs, templates, markup techniques and our own copyright material (including website text, layout and photographs), except to the extent we are paid to create bespoke drawings for you.
We will not use your drawings for other customers without your permission, and we will not pass your commercial information to third parties except as described in our Privacy Policy.
Goods may be collected from our Peakhurst workshop or delivered by arrangement. Risk in the goods passes to you on delivery to the carrier or on collection, whichever occurs first. Title in the goods does not pass until we have received cleared payment in full. Lead times are estimates; we will advise as soon as practicable if a job is likely to be delayed.
To the extent permitted by the Australian Consumer Law, our goods come with guarantees that cannot be excluded. We warrant that fabricated goods will be manufactured in a workmanlike manner and in accordance with the confirmed drawing and specification. If a good or service supplied by us has a problem covered by the consumer guarantees, we may choose to remedy the fault by repairing the goods, replacing them, or issuing a credit or refund. We are not liable for faults caused by misuse, incorrect installation, modification after delivery, or exposure to conditions outside the specification we agreed.
To the fullest extent permitted by law, AMS is not liable for any indirect, consequential or loss of profits, loss of production, loss of contract or economic loss arising from your use of this website or reliance on its content, except where such liability cannot be excluded under the Australian Consumer Law. Our maximum liability for any claim arising from goods supplied is limited to the value of the relevant order.
This website may contain links to external websites for convenience. We do not control and are not responsible for the content, privacy practices or availability of those external sites.
You agree not to use this website for any unlawful purpose, to upload or transmit malicious code, to attempt to disrupt the site, or to scrape or copy our content for commercial reuse without our written permission. The AMS Fabrication name, logo and website content are protected by copyright and trade mark law.
We may update these Terms & Conditions from time to time. The current version will always be available on this page. Your continued use of the site after changes are published constitutes acceptance of the updated terms.
